Put simply, if they don’t appear to have assets, you need to know at the earliest opportunity. Instructing a solicitor on a fixed fee basis can also quite often improve the chances of a mediated solution, poarticularly if 2 sensible sets of solicitors are representing the parties. In those circumstances the solicitors can seek to quickly get a fuller  picture of each side’s case and encourage the parties to find a mediated solution, which can be backed up by a formal order, enforceable at court if breached.
