Basic Financial considerations of courts on divorce
The Courts are bound to apply a number of established considerations when accessing finances, but first and foremost and outweighing any other factors the court must put the welfare of children of the family first and then also consider :-
- The parties income, respective earning capacity, property, and other financial resources
- Financial needs of the parties, their obligations and responsibility
- The standard of living previously
- The age of the parties and length of the marriage
- Any physical or mental disabilities
- Contributions to the marriage
- Conduct of the parties although this is not given much weight generally
- Pensions and other benefits of either party
- Generally, the overall circumstances.
