Failure to Notify Driver Details
What does failure to notify driver details mean?
Although the technology is now available, the vast majority of speed cameras are only able to record details of cars involved in road traffic offences. This means that should you be caught speeding or wrongly using a bus lane by traffic devices, under the Section 172 Road Traffic Act 1988 you will have to inform the police of who was driving the car at the time of the offence.
What’s the punishment for failure to notify driver details?
Failure to notify your details is an offence in itself which can attract a £1000 fine, six penalty points on the license and a possible ban from driving.
Any defences?
If you have taken all reasonable steps possible to notify the police of your details and for some reason the police claim they have not received such notification, you could have a possible defence. If, for example, you were to actually go to the police station and notify the police, your duty might be seen as being discharged at that point, all other things being equal.
